MVA / Personal Injury Overview
Claims arising from injury or death are generally instituted against a wrongdoer. Statutory and contractual and common law procedures prescribe:
- Injury and death claims against the Road Accident Fund have a number of statutory limitations which now excludes recourse against a wrongdoer or third party.
- The nature and determination of the severity of injuries arising from motor vehicle accidents are complex in nature and will require determination by experts appropriate to the nature of injuries and disabilities.
- Personal injury claims: Can be recovered from the wrongdoer (personally or vicariously), an Insurer, and an Organ of the State.
- A variety of time restrictions are placed on these claims which could become prescribed should proper notice not be given in good time.
